SECTION IX—Arrest Powers

(A) In accordance with applicable law and delegated authority, law enforcement officers may make arrests and shall effect all arrests in accordance with applicable law. In all instances regarding the arrest process, law enforcement officers shall endeavor to protect the rights of those arrested, while at the same time providing for the safety of the public, the law enforcement officers, and the subject.
(B) Each law enforcement unit shall coordinate the exercise of arrest authority by law enforcement officers with the United States attorneys for the Districts in which the law enforcement unit expects its law enforcement officers to make arrests for criminal violations of United States law. The law enforcement unit shall adopt policies and procedures consistent with the United States attorneys’ policies regarding the handling of concurrent- or overlapping-jurisdiction offenses and declination standards.

(C) Effecting an arrest.
(1) Consistent with the jurisdictional limits set forth in these regulations and with the policies of the law enforcement officer’s law enforcement unit, where exigent circumstances prevent a law enforcement officer from obtaining a warrant, a law enforcement officer may effect an arrest without a warrant based on—
(a) the commission of any crime that violates federal law committed in the law enforcement officer’s presence while the law enforcement officer is on duty, or
(b) the commission of any felony that violates federal law if the felony was committed or is being committed on any lands or within a facility owned or leased by any entity within the Federal Reserve provided that the law enforcement officer has a reasonable belief that the person to be arrested has committed or is committing such a felony.
(2) A law enforcement officer may effect an arrest while on duty when the law enforcement officer has knowledge of an outstanding arrest warrant against the subject.
(3) A case report shall be completed in all situations in which a law enforcement officer makes an arrest and shall become an official document of any investigation. The report shall be filed with the responsible law enforcement manager, responsible internal oversight committee (as defined below) and with the external oversight function (as defined below).
