The Board may, in its discretion, designate
itself, one or more of its members, or an authorized officer, to act
as presiding officer in a formal hearing. In such a proceeding, the
authority of Board or its designee will include all the authority
provided to an ALJ under this part. Proposed findings and conclusions,
briefs, and other submissions by the parties permitted in subpart
A of this part must be filed with the secretary for consideration
by the Board. Sections 263.38 and 263.39 will not apply to proceedings
conducted under this section.
