(a) Party prehearing submissions. Within the time set by the ALJ,
but in no case later than 20 days before the start of the hearing,
each party must file with the ALJ and serve on every other party:
(1) A prehearing statement that states:
(i) The party’s position with respect to the legal issues presented;
(ii) The statutory
and case law upon which the party relies; and
(iii) The facts that the party expects
to prove at the hearing;
(2) A final list of witnesses to be called
to testify at the hearing, including the name, mailing address, and
electronic mail address of each witness and a short summary of the
expected testimony of each witness, which need not identify the exhibits
to be relied upon by each witness at the hearing;
(3) A list of the exhibits expected to
be introduced at the hearing along with a copy of each exhibit; and
(4) Stipulations of fact,
if any.

(b) Effect of failure to
comply. No witness may testify and no exhibits may be introduced
at the hearing if such witness or exhibit is not listed in the prehearing
submissions pursuant to paragraph (a) of this section, except for
good cause shown.
